Terms and Conditions

In accordance with the Croatian Real Estate Law from 2. November 2007 we, the real estate agency "TopAdria", Thiele d.o.o. (l.l.c.), MB 2424177, MBS: 130032020, OIB 96576994020, (refered to as "agent" below) adopt the following
 
General Terms of Business

Here we present a shortened version of the Croatian description for information purposes only. Please refer to the Croatian version for further details.
 
Obligations of the agent
1. to form a brokerage contract with the principal of a property (i.e. the property owner(s) / seller(s))
2. to find a principal / a property in order to establish a contract for which the agent has mediated
3. to estimate (not to determine) a reasonable market value of a property and to inform the principal about it (the principal is free to set his or her asking and sales price)
4. to inform the principal about the property market as pertaining to the property for sale and to inform him of any deficiencies of the property the agent might notice 
5. to inspect the relevant property documents and to advise the principal of possible problems
6. to inform the principal on legal and other obligations which may arise during and after the buying / selling process
7. to advertise the property for sale
8. to organize site visits with potential buyers of the property
9. to keep the principal's data and other personal information a business secret
10. to inform the principal of all situations which are relevant to the buying / selling process
11. to mediate in the purchasing negotiations and to attempt to conclude the buying / selling process
12. to assist a notary public and / or an attorney in the preparation of all legal documents necessary to the transfer of ownership (the sales contract, the preliminary sales contract)
13. to assist in handing over the property to the new owner(s).
 
Obligations of the seller(s)
1. to form a brokerage contract with the real estate agency
2. to present all documents relevant to the property to the agent
3. to inform the agent about all relevant information regarding the property
4. to allow site visits to agent(s) and potential buyers
5. to pay the agreed agency fee (commission) to the real estate agency on time
6. to cover all expenses which may arise during the mediation process which are not considered standard costs
7. to inform the agent about all changes which may occur to the property after the brokerage contract has been signed
 
Obligations of the buyer(s)
1. to form a brokerage contract with the real estate agency
2. to provide any relevant details of the potential buyer(s) to the agency
3. to agree to and to pay the agency fee on time and in according to the terms provided by the real estate agency in case of a sale and / or any other fee agreed to with the agency
 
Agency fee (commission)
The buyer's commission amounts to 3 % + VAT of the purchase price (with a minimum of 7,500 Kuna) payable at the time of the sales contract. 50% of the commission is due at the time of signing a pre-contract (should there be one).
